Terms of Use for Cake Constructor Website and Service
These Terms of Service (hereinafter referred to as the "Terms") govern the access and use of the website https://cakeconstruktor.online and its integrated software interfaces, including the 3D builder and AI assistant (hereinafter referred to as the "Service") by individuals and legal entities (hereinafter referred to as the "User" or "You").
1.1. Service — the proprietary software suite managed by the Administration, including the 3D interactive cake configuration engine, user admin panels, catalog vitrine, and the AI customer assistant.
1.2. User — any individual, professional pastry chef, home baker, or bakery business entity who registers an account or browses the public interfaces of the Service.
1.3. Administration — the lawful owner and operating entity of the Cake Constructor platform.
2.1. Access to full business functionalities (saving 3D configuration fields, launching the AI assistant, or setting up a public vitrine catalog) requires mandatory registration via Email, Google OAuth, or Instagram OAuth protocols.
2.2. Any interaction with the Service (including simple website browsing) implies full compliance with these Terms. If you do not accept these Terms, you must immediately cease using the platform.
2.3. The User is entirely responsible for maintaining the privacy and security of their OAuth authorization tokens and account login credentials. All actions performed inside the dashboard using the User's credentials are legally attributed to the User.
3.1. All original design elements, proprietary 3D rendering scripts, mathematical tier algorithms, standard 3D asset shapes, icing/fondant texture patterns, and UI designs are the exclusive intellectual property of the Administration.
3.2. The User is prohibited from:
— Reverse engineering, decompiling, scraping, or attempting to extract the web GL/3D engine source code.
— Deploying automated crawlers, parsers, or extraction bots to download 3D assets or textual data from the platform.
— Launching white-label clone products built upon the visual infrastructure of Cake Constructor.
3.3. **User Content:** Any photos, specific baking recipe descriptions, custom price listings, and unique logos uploaded by the User belong solely to the User. The User guarantees they hold all commercial copyright permissions for uploaded media assets.
4.1. The User agrees not to host or showcase products that are fraudulent, misleading (such as passing off another baker's catalog work as their own), or in violation of local trade laws.
4.2. The Administration executes zero pre-moderation over User vitrines but holds the explicit right to suspend accounts or delete malicious catalogs immediately and without notice upon receiving verified copyright claims or consumer complaints.
5.1. **Platform Operations:** Processing of the User's identity records (email, full name, profile image) is described in our core Privacy Policy.
5.2. **End-Client Data (Crucial for GDPR compliance):**
— When a consumer uses the User's embedded 3D builder or chats with the AI assistant to buy a cake, they provide personal details (name, delivery address, phone, dietary/allergy remarks).
— The User (Bakehouse/Confectioner) is strictly recognized as the **Data Controller** under GDPR/CCPA and assumes full, absolute legal liability for harvesting local consents and maintaining end-user privacy rights.
— The Service acts purely as a technical infrastructure layer (**Data Processor**). We process end-customer telemetry solely to execute your orders and do not monetization, sell, or utilize your client's data for external actions.
6.1. The system is served on an "as is" and "as available" basis. The Administration does not guarantee uninterrupted runtime, absolute ИИ text precision, or total server resistance to web anomalies.
6.2. The Administration is completely insulated from business operational variables. We bear zero liability for missed profit margins, bad cake parameter assessments, wrong calculations, or delivery logistics failures.
6.3. **Cap on Liability:** To the maximum extent permitted by applicable law, the cumulative liability of the platform for any damage claims is capped at **$50.00 USD** (or the equivalent subscription cost paid by the user during the last calendar month).
7.1. These Terms are construed under international business software framework principles. When processed through Lemon Squeezy, standard corporate legal frameworks apply.
7.2. The Administration can edit these Terms dynamically. Continued interaction with your platform dashboard after an online text edit constitutes full agreement to the updated versions.
